1) it was completely unintentional with his hands not in an outstretched position. Sure his arm isn't at his side, but this doesn't matter much when–
2) he did nothing to change the course of play. The ball was going OUT anyways, with no chance for the Porto player to get it. It's like when a defender fouls an attacker in the box, but the ball was kicked way too far ahead for the attacker to get and would have gone out if he wasn't fouled, so no penalty is given.

The offside rule was created to address the problem of a bunch of players just camping at the opposition goal and receiving the ball from across the field to score easily. There stops being an advantage when the ball is already ahead of the attacker (and it didn't arrive to someone who was offside), as the defenders are given a fair chance to keep their formation and follow play. Hope that makes sense, I know it's quite convoluted.
2 penalties forgiven?? Yeahhh right, both scenarios are ball to hand, which means not deliberate, which also means according to FIFA rules, NOT a penalty.
